James D. Curran is an experienced litigator well known for his success in handling surety and construction-related matters. Mr. Curran’s practice is primarily devoted to complex commercial litigation and includes representing contract and commercial sureties, contractors, subcontractors, and other businesses in a wide variety of surety, construction, and business disputes.

Mr. Curran’s surety and construction litigation experience involves both contract and commercial claims. Mr. Curran assists clients in resolving contract issues, completing projects, resolving payment claims, pursuing indemnity and collateral, recovering assets, and working through bankruptcy issues. The types of projects in which Mr. Curran regularly is involved include public and private works, schools, libraries, subdivisions, roadwork, freeways, dams, office buildings, commercial spaces, laboratories, and apartment and condominium complexes. The types of issues in which Mr. Curran is regularly involved include interpretation and enforcement of contracts, delays, disruptions, impacts, acceleration, allegations of bad faith and unfair claims practices, labor claims, class-action disputes, and prevailing wage violations.

Whether the matter is worth tens of millions or tens of thousands, Mr. Curran’s focus is always on obtaining the best result for the client. Mr. Curran works with the client to position the issue for a negotiated resolution, usually by working with the other parties involved, or through mediation or other form of alternative dispute resolution. If litigation is necessary, Mr. Curran is very experienced with winning cases in both trial and appellate courts.

Mr. Curran received his Bachelor of Arts from Santa Clara University in 1980, and his Juris Doctor from Santa Clara University School of Law in 1986. Mr. Curran is a member of local, state and national bar associations, including the State Bar of California, American Bar Association, Torts and Insurance Practice Section, the Fidelity & Surety Law Committee, the Forum on Construction Industry, and the Associated General Contractors. Mr. Curran has been named as being one of “Northern California’s Super Lawyers” for numerous years.
